you prepared a proofmaking model analysis of a NSW District Court matter. In this activity, you will prepare an initial letter of advice to your client in the same file.

You will consider the initial steps required when acting for a client in a civil litigation matter. These steps are common to all litigation:

taking comprehensive and detailed instructions from your client

identifying your client’s objectives – legal and non-legal

providing your client with a preliminary oral advice

entering into a costs agreement with your client

carrying out preliminary investigations and gathering evidence

observing obligations under any relevant legislation such as the Civil Dispute Resolution Act 2011 (Cth) (CDRA), and

providing your client with appropriate written advice.
